Understanding Dishonoring of Cheques in Pakistan
Introduction: In Pakistan, a dishonored cheque is one that is refused payment by the bank due to insufficient funds or failure to meet legal requirements. Issuing a dishonored cheque intentionally is a criminal offense under Section 489-F of the Pakistan Penal Code, 1860.
Legal Framework: Section 489-F addresses the crime of dishonesty issuing a cheque for repayment of a loan or obligation that is later dishonored. It specifies that the offender may face imprisonment of up to three years and/or a fine, unless they can prove that they made prior arrangements with the bank to ensure the cheque would be honored and that the bank is at fault for its dishonoring.
